Agency Workers Regulations
The Agency Workers Regulations (AWR) will come into force on 1 October 2011. You can obtain a full copy of the Government’s published guidance for employers and recruitment agencies by using the following link:- published guidance Essentially, agency workers will be given the right to the same basic employment and working conditions, such as pay and holidays, as permanent staff and will be entitled to use collective facilities, including canteens and childcare facilities, from the first day of their appointment. The regulations will give agency workers the entitlement to the same or no less favourable treatment as comparable employees with respect to basic employment and working conditions, if and when they complete a qualifying period of 12 weeks in a particular job.

When the law changes 1st October 2011

  1. Agency workers will be entitled to same basic employment and working conditions as if they had been recruited directly.
  2. To qualify, an agency worker will need to complete a qualifying period of 12 weeks in the same job.
  3. Note:- It is not retrospective and for those agency workers already on assignment, the 12 week qualifying period will start from 1 October 2011.
  4. Agency workers will be entitled to access facilities such as canteen, childcare facilities and other facilities that permanent workers are currently entitled to.
  5. They will also be entitled to information on job vacancies on the 1st day of their assignment.
  6. After 12 weeks in the same job the equal treatment entitlements relate to pay and other basic working conditions (annual leave, rest breaks etc) and come into effect after an agency worker completes a 12 week qualifying period in the same job with the same hirer.
  7. After completing the 12 week qualifying period, pregnant agency workers will now be allowed to take paid time off for ante-natal appointments during an assignment.
